Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Zapp (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms apply to all users of the App, including anonymous users, registered account holders, and paying subscribers.

2. Eligibility

You must be at least 13 years old to use Zapp (or the applicable minimum age in your jurisdiction, such as 16 in parts of the EU). By using the App, you represent and warrant that you meet this requirement.

If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Accounts

3.1 Account Creation

You can use Zapp anonymously for a limited number of AI interactions. To continue playing beyond the free anonymous limit, you must create an account using Apple Sign In or Google Sign In.

You are responsible for maintaining the security of your account. You agree to notify us immediately at retrospective.technology@gmail.com if you become aware of any unauthorized use of your account.

3.2 Account Accuracy

You agree to provide accurate information during account setup. Display names must not impersonate other people, entities, or Zapp itself, and must not be offensive, vulgar, or otherwise objectionable.

3.3 Account Termination by You

You may delete your account at any time via Settings → Delete Account in the App, or by emailing us. Deletion removes your data as described in our Privacy Policy.

4. Acceptable Use

You agree to use Zapp only for its intended purpose: playing party games with other people present in person. You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the App or its backend services.
• Interfere with or disrupt the integrity or performance of the App or its servers.
• Submit content that is illegal, defamatory, harassing, threatening, obscene, or otherwise objectionable.
• Impersonate any person or entity, or falsely claim an affiliation with any person or entity.
• Use the App to collect or harvest personal data about other users without their consent.
• Attempt to gain unauthorized access to any part of the App, its backend systems, or another user's account.

5. AI Features and Endpoint Use Policy

Zapp's AI-powered game modes (such as "Convince the AI") use backend AI infrastructure to process player inputs and generate responses. These features are provided for legitimate, in-person party game play only.

5.1 Prohibited AI Use

The following uses of Zapp's AI features are strictly prohibited:

• Automated or programmatic requests: Using scripts, bots, automated tools, or any non-human means to submit requests to Zapp's AI endpoints.
• Rate limit circumvention: Attempting to bypass, manipulate, or work around anonymous usage limits or per-account AI call limits, including by creating multiple accounts, spoofing device identifiers, or using shared credentials.
• API scraping or extraction: Intercepting, capturing, or replicating Zapp's backend API requests or responses for any purpose outside of normal App use.
• Adversarial or harmful input: Submitting prompts or clues designed to elicit harmful, offensive, or policy-violating outputs from the AI model, or to probe or attack the underlying AI system.
• Resale or commercial exploitation: Using Zapp's AI capabilities as a backend for another product or service.

5.2 Monitoring and Enforcement

We monitor AI endpoint usage for anomalous patterns, including but not limited to: unusually high request volumes, requests originating from non-App clients, and patterns inconsistent with normal game play. We reserve the right to:

• Immediately suspend or permanently terminate any account we determine, in our sole discretion, to be engaged in abusive, automated, or otherwise prohibited AI endpoint use.
• Rate-limit, throttle, or block individual accounts, devices, or IP addresses without notice.
• Retain logs of suspicious activity for the purpose of investigating and preventing abuse.

Accounts suspended for AI abuse are not eligible for refunds of any unused subscription time or session passes, to the maximum extent permitted by applicable law.

5.3 AI Output Disclaimer

AI responses generated by Zapp (including guesses, reasoning, and mascot lines) are produced by a third-party AI model and are for entertainment purposes only. They may be inaccurate, nonsensical, or unexpected. We do not guarantee the accuracy, quality, or appropriateness of AI outputs. Zapp is not liable for any reliance placed on AI-generated content.

6. User-Submitted Content

Certain game modes allow you to type short text inputs (such as clues in "Convince the AI" or prompts in "Imposter"). You are solely responsible for any content you submit.

By submitting content, you represent that it does not violate any law or third-party rights, and you grant us a limited, non-exclusive license to process and transmit it solely to operate the App (including forwarding clues to our AI backend).

We do not permanently store clue content submitted to AI endpoints. See our Privacy Policy for details.

7. Purchases and Subscriptions

7.1 Available Purchases

• Zapp Premium (monthly subscription): Unlocks unlimited gameplay at $4.99/month (or equivalent in your local currency), billed monthly through the App Store or Google Play.
• Session Pass (one-time purchase): Unlocks 24 hours of unlimited play for $1.99. Processed as a consumable purchase. Session Passes are non-transferable and non-refundable once activated.

7.2 Billing and Payment

All payments are processed by Apple (App Store) or Google (Google Play). We do not collect or store your payment information. Subscription prices may vary by region and are subject to change. You will be notified of price changes through the App Store or Google Play in accordance with their policies.

7.3 Subscription Renewal and Cancellation

Subscriptions automatically renew each billing period unless cancelled at least 24 hours before the renewal date. To cancel, manage your subscription through your device's App Store or Google Play subscription settings. Cancellation takes effect at the end of the current billing period — you retain access until then.

7.4 Refunds

All purchases are subject to the refund policies of Apple or Google respectively. We do not process refunds directly. If you believe a purchase was made in error or your entitlement was not delivered, contact us at retrospective.technology@gmail.com and we will investigate.

7.5 Free Tier Limits

Zapp provides a limited number of free AI interactions for anonymous users and a limited number of free games for authenticated free users. We reserve the right to adjust these limits at any time.

8. Account Suspension and Termination

We reserve the right to suspend, restrict, or permanently terminate your account at any time, with or without notice, at our sole discretion, including but not limited to the following situations:

• Violation of any provision of these Terms.
• Suspected or confirmed abusive, automated, or fraudulent use of AI endpoints or other backend services (see Section 5).
• Fraudulent purchase activity, including chargebacks or attempts to exploit purchase flows.
• Conduct that we determine, in our sole discretion, poses a risk to other users, our systems, or third parties.
• Any illegal activity conducted through or in connection with the App.

Upon suspension or termination, your right to use the App ceases immediately. We are not obligated to provide a refund for any unused subscription time or session passes in cases of termination for cause, to the maximum extent permitted by applicable law.

If you believe your account was suspended in error, contact us at retrospective.technology@gmail.com with a description of the situation. We will review appeals at our discretion.

9. Intellectual Property

The App, including its design, branding, mascot character (Zapp), game mechanics, original content, and underlying software, is owned by us or our licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial, in-person entertainment purposes. You may not copy, modify, distribute, sell, or sublicense any part of the App.

Nothing in these Terms grants you ownership over any element of the App. Feedback or suggestions you provide to us may be used to improve the App without any obligation to compensate you.

10. Third-Party Services

Zapp integrates with the following third-party services to operate:

• Supabase — authentication, database, and backend functions
• Microsoft Azure AI Foundry — AI model hosting for game features
• RevenueCat — purchase and entitlement management
• Apple / Google — sign-in and payment processing
• PostHog — product analytics

Your use of the App is also subject to the terms and privacy policies of these providers. We are not responsible for the practices of these third-party services. Disruptions or failures in third-party services may affect App functionality; we are not liable for such disruptions.

11. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. AI-generated content (guesses, mascot responses) is for entertainment only and may be inaccurate or unexpected. We make no representations about the quality or accuracy of AI outputs.

12. Limitation of Liability

To the maximum extent permitted by applicable law, we and our affiliates, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to loss of data, loss of profits, or damage to devices.

Our total aggregate liability to you for any claims arising from your use of the App shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $10.

13. Governing Law and Disputes

These Terms are governed by applicable law. If you have a dispute with us, you agree to first contact us at retrospective.technology@gmail.com to attempt informal resolution before pursuing any formal proceedings.

If you are a consumer in the European Union, you benefit from the mandatory consumer protection provisions of the laws of your country of residence, which apply regardless of any choice of law clause.

14. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, stop using the App and delete your account.
